Terms and Conditions

These Terms and Conditions govern all agreements between FIRM Landscaping (referred to as “Contractor”) and its clients (referred to as “Client”). By signing a quote or contract, the Client acknowledges and accepts all terms outlined below. 

1. Job Scope 

  • All work performed is strictly limited to the scope outlined in the approved quote. 

  • Any additional work or modifications require prior written consent from both the Contractor and the Client. 

  • Unauthorized requests for extra work will not be accommodated. 

 

2. Quote Acceptance 

  • By signing the quote, the Client agrees to all terms and conditions stated herein. 

  • Attempts to cancel or abandon the quote without mutual agreement may result in cancellation fees at the Contractor's discretion. 

 

3. Down Payment 

  • If a down payment is required, no work will begin, nor will scheduling occur, until the payment is received in full. 

  • Delays in receiving the down payment may result in rescheduling or termination of the agreement. 

 

4. Scheduling and Delays 

  • The Contractor reserves the right to schedule and reschedule work for efficiency. 

  • The Contractor is not responsible for delays caused by factors beyond its control, such as weather or unforeseen events. 

 

5. On-Site Conduct 

  • Contractor personnel must not be subjected to physical or verbal harassment. 

  • The Client must refrain from micromanaging or directing on-site workers. 

  • Inappropriate conduct may result in suspension of services. 

 

6. Materials and Liability 

  • Upon delivery, all materials become the responsibility of the Client. 

  • The Contractor is not liable for theft, vandalism, or damage caused by third parties. 

 

7. Sales Tax 

  • All charges are subject to a 5% GST tax in accordance with applicable laws. 

 

8. Payment Terms 

  • Payments are due within 15 days of invoicing. Late payments incur a 2% interest fee per week. 

  • Large projects may require milestone payments, and work may pause until milestones are paid. 

 

9. Change Orders 

  • Any changes exceeding $200 require a formal, written change order signed by both parties. 

 

10. Promotional Use 

  • The Client permits the Contractor to use images or descriptions of completed work for promotional purposes, including social media and advertising.

11. Right of Refusal 

  • The Contractor reserves the right to refuse service or terminate the agreement if the Client violates these terms.

12. Warranty 

  • Upon completion, the Client assumes responsibility for proper maintenance unless a maintenance agreement is in place. 

  • Plants may experience transplant shock and require adequate care from the Client. 

  • The Contractor offers a 30-day warranty for plant replacement due to its own fault. 

  • The Contractor is not liable for plant loss due to Client neglect or insufficient care. 

  • A maintenance guide and optional care plan will be provided. If the Client does not initiate the care plan and a plant dies within the 30-day period, the Contractor reserves the right to charge for replacement. 

  • Sod, seed, and transplanted existing plants are not covered under warranty. 

  • Replacement of plants exceeding a 5-gallon pot size incurs additional labor charges.

By accepting the quote, the Client agrees to all terms and conditions, establishing a binding agreement with Firm Landscaping Ltd.
